General Terms and Conditions of Use of the Wallible Platform
These General Terms and Conditions of Use (hereinafter also “GTU”) govern services offered through the Wallible platform accessible from the website of the same name www.wallible.com (hereinafter also “Site”).
Wallible (hereinafter also “W” or “Provider”) provides you with guidance on the functionality of the platform and the services offered by it when you access it and reserves the right to change these GTU from time to time.
This will normally be in response to a change in legislative or regulatory requirements or a change in internal policy.
In the event that these GTU are changed Wallible will notify users of the change through an email/notification message directly on the Platform.
After such notification, the user will be free to accept the variation and continue using the Platform or reject the variation and discontinue its use.
In the case of rejecting the variation, Wallible will suspend the User by preventing him/her from accessing the Platform.
By using the Platform, the User declares that he/she accepts and is familiar with these terms of use as well as the Privacy Policy and Cookie Policy of the Wallible Platform contained in the appropriate section, accepting their content in full.
Access to the Platform and the use of related services are exclusively intended for Users as better identified below.
Definitions.
For the purposes and effect of these Terms of Use, the following definitions shall apply:
- “User”: the natural person located within the E.U. or outside the member countries of the European Union who wishes to make use of the services offered by the Wallible Platform.
- “Services”: the offer of the tools on the Wallible platform and what is related to them;
- “Beta version”: is the demo version of the Wallible web platform that incorporates professional investment analysis and optimization tools.
Privacy.
The User is invited to consult our Privacy Policy and Cookie Usage Policies that govern the use of the “Services” provided on the platform.
Registration and Restrictions on Platform Use.
The Wallible Platform currently online is nothing more than a “demo” version, totally free and not intended for distribution to, or use by, any person.
In fact, access to this version requires that the User explicitly request access to the platform in the beta version. The info requested from the User at this stage are: “name”, “email”, “how did you get to us”, “phone (optional)”.
Once the form is filled out, the system will automatically send an email to the operator info@wallible.com, which in turn will send an email with the credentials to access the beta version platform.
The platform may not be used by individuals under the age of 18.
The Wallible platform and any other services provided by us are not available to persons residing in any country where trading or other such services would be contrary to local law or regulations.
It is your responsibility to ascertain the terms, and comply with any local laws or regulations to which you are subject. Without derogating from the foregoing, Wallible reasonably reserves the right to suspend and/or refuse access to or use of the Platform to anyone.
Our Services.
Wallible provides a web platform that incorporates professional investment analysis and optimization tools that can be accessed through the website www.wallible.com. In its beta version, the platform only allows the use of features related to the Pic or Pac Simulator and the Correlator.
Regulation Of Services.
The Services referred to in the preceding point are the only ones usable by the User in the present beta version of the Wallible platform.
In this version, therefore, it will not in fact be possible to perform any type of action different from that described in the preceding point.
Under no circumstances will it be possible to execute any investment transactions, nor will it be possible to keep track of the history of one’s transactions.
All actions related to trades made in the demo version will not be saved in any way in the history of the User who in fact, once logged out of his account, will no longer be able to see the trades made in the previous session.
Service Limitations - Exclusion of Specialized Consulting Activities.
Under no circumstances does Wallible’s activity qualify as specialized consulting. Wallible does not provide personalized investment recommendations or investment or tax advice. Any explanation or information we provide in the context of a transaction or on the execution of the transaction is not intended, and should not be considered, as advice.
The Wallible platform is not considered an exchange or marketplace.
Wallible may not provide all of our Services to customers domiciled in certain countries due to restrictions under Applicable Law (“Restricted Countries”).
If You reside in a Restricted Country You may only have access to some of the Services offered.
Risks Associated with the Use of the Wallible Services.
Being a beta version with reduced functionality, no possibility of risks related to the use of the platform is found. Also, in this version, it is not possible to create any customer wallet and/or use money.

Intellectual Property
All content included in or made available through the Services, by way of example only, all copyrights, trademarks, patents, service marks, domain names, trade names, rights in designs, software code, icons, logos, fonts, layouts, know-how rights, trade secrets, buttons, color schemes, graphics and other intellectual property rights (“Intellectual Property”) are owned by Wallible and are protected by local and international intellectual property laws and treaties.
You may not under any circumstances, without the prior written consent of Wallible:
- modify, copy, display, distribute or commercially exploit any Intellectual Property or material (including text, video, audio, user interface design) found in the content of any Service;
Use of the Services does not grant you any rights other than those granted under these Terms of Use. Nothing contained on the website, in communications addressed to you or on the web platform shall be construed as granting, by implication or otherwise, any license or right to use any Intellectual Property without Wallible’s prior written consent.
User then agrees:
- to endeavor to protect Wallible’s Intellectual Property from infringement on your part;
- not to knowingly or recklessly encourage or assist any third parties to infringe the Intellectual Property of the Wallible platform and site;
- to notify immediately if he/she becomes aware of any infringement or suspected infringement of Intellectual Property, or if Wallible’s Intellectual Property is used in a manner not authorized by these Terms of Use.
Please notify Wallible in writing if you encounter any problems with the platform or have any suggestions for changes and improvements.
We may make changes to the platform based on your suggestions, but Wallible is under no obligation to do so. Any changes and improvements made to the platform based on user feedback will be the sole property of Wallible and our licensors.
Applicable Law and Regulation.
These Terms of Use are subject to applicable laws and regulations, including (but not limited to), regulations, policies, and any other applicable regulatory, self-regulatory, or governmental authority requirements (“Applicable Law”).
Applicable Law and Jurisdiction.
The laws of the State of Italy shall apply to these Terms of Use. Any claim against Wallible may be dealt with in the Court of Pistoia.
